January 5, 2016 2015-CT-1557-A/E Judge Blechman
Facts:The Defendant was stopped after swerving several times while driving through a construction zone at night. The Defendant admitted to drinking a few drinking and showed signs of impairment. The Defendant completed field sobriety exercises and was arrested. The Defendant took a breath test and the results were 0.77. The Defendant was charged with DUI. This would have been the Defendant's second DUI within 5 years and he was looking a minimum mandatory jail time.
Defense: We challenged the stop, arrest, and breath test. We filed many pre-trial motions and set them for hearings.
Result: .The State dismissed the DUI.
November 30, 2015 2015-CT-1621-A/E Judge Starr
Facts: The Defendant was stopped after failing to come to a complete stop sign. He was on his way downtown with a few friends in the car. The Defendant showed signs of impairment and admitted to drinking a few drinks prior to driving. He performed pretty well on field sobriety tests and was arrested for DUI. He passed a breath test and then refused to take a urine test.
Defense: We challenged the arrest, the field sobriety tests, and the refusal to to take a urine test. We filed many pre-trial motions, set, and conducted pre-trial hearings challenging evidence.
Result: The State dismissed all charges.
October 30, 2015 2015-CT-1621-A/E Judge McGinnis
Facts: Law enforcement observed the Defendant driving a scooter approaching a stopped vehicle at a stop sign. The Defendant rolled through the stop sign and began to race the race as the car raced the Defendant. The Defendant was arrested and charged with drag racing.
Defense: We pointed out the details of the drag racing statute and convinced the state prosecutor that he could not prove the case.
Result: State Dismissed the drag racing charge.
October 26, 2015 2015-CT-6386-A/O Judge Bell
Facts: Law enforcement responded a crash with two vehicles and determined that the Defendant ran a stop sign and hit another car. The Defendant smelled of alcohol and admitted that he was coming from a party where he had been drinking. The Defendant performed field sobriety exercises and did pretty well. The Defendant was arrest and later refused to take a breath test.
Defense: The Defendant was new to the U.S. and didn't speak great english. We filed numerous motions to suppress evidence including motions related to a misunderstanding with the breath test request and instructions.
Result: State Dismissed the DUI.
October 15, 2015 2015-CT-671-A/A Judge Blechman
Facts:Law enforcement responded to a fast food restaurant after reports of a male and female arguing who appeared to be under the influence. When law enforcement arrive, the Defendant was leaving the parking lot through a do not enter driveway. Law enforcement observed the Defendant arguing with a female, appeared to be impaired and had two open beers in his vehicle next to him. Field Sobriety Exercises were performed and the Defendant was arrested. He refused a breath test.
Defense:We filed numerous motions to suppress evidence and ultimately set the matter for trial. On the day of trial the state dismissed the DUI.
Result: State Dismissed the DUI.
